The Hidden Risks of Selling a Home in Arizona

Selling a home isn’t just about finding the right buyer or getting the best price—it’s also about protecting yourself from risk. For most homeowners, this is the single largest financial transaction they’ll ever make, and what many don’t realize is that your responsibility doesn’t end when the ink dries at closing.

In Arizona, sellers are required to complete detailed disclosures and comply with very specific contract requirements. If something is missed—or if the wrong assumption is made—those oversights can come back months (or even years) later in the form of lawsuits, demands for compensation, or costly repairs you thought you’d left behind.

The scary part? Most sellers don’t see the trap until they’re already in it. That’s why choosing the right brokerage—one that prioritizes advanced education and risk management—isn’t optional. It’s the smartest decision you can make before listing your home.


Why I’m Investing in Advanced Risk Management Training

As the Designated Broker of EXIT Realty Sun City, I don’t just represent clients—I lead an office of professionals who represent buyers and sellers every day. That leadership comes with responsibility. It’s my job to ensure that our entire team is operating at the highest level of professionalism, compliance, and care.

That’s why I enrolled in the Certified Risk Management Specialist (rCRMS) training through the Arizona REALTORS® “Mastering The Residential Resale”. This program is one of the most advanced continuing education designations in our industry, and it’s designed specifically to help REALTORS® protect their clients from unnecessary risk.

This specific class was a two day deep dive into 9 hours of Contract Law and 3 hours of Disclosures. Why? Because those are the exact areas where sellers often find themselves exposed to liability they never expected. By mastering this training, I can better guide my agents—and by extension, our clients—through the process with fewer headaches, fewer surprises, and a stronger layer of protection.


Why Continuing Education Matters More Than Ever

Real estate isn’t static—it’s constantly shifting. Laws change. Market conditions fluctuate. The contracts we use in Arizona are regularly updated to reflect both legislative changes and court rulings.

A great example: The Arizona Association of REALTORS® recently revised the statewide contract documents, a project led by Jan Steward, the Sr. Director of Risk Management developed a workgroup of statewide veteran professionals led by 30 year plus experienced Broker Jim Sexton, to make sure our forms reflect new realities in the market after recent national legal settlements. These changes impact every seller, every buyer, and every transaction in Arizona moving forward.

Also leading the classroom training was  Richard V. Mack, Partner at Zelms Erlich Lenkov, AV Preeminent®, Super Lawyer, and certified Real Estate Specialist—his expertise in real property litigation and professional liability sets a gold standard.  Rick has also been instrumental in reviewing and developing Arizona real estate contracts for over 25 years and is a wealth of knowledge on the types of cases that are currently being waged in Arizona courts.

Here’s the truth most sellers don’t hear: Not every agent keeps up. According to the National Association of REALTORS®, fewer than 40% of agents hold even one professional designation. That means a majority are operating with the bare minimum training required for licensure—training that may already be outdated by the time they’re working on your deal.

At EXIT Realty Sun City, I won’t accept that for our clients. Ongoing education and risk management training are part of our culture, because when you hire us, you deserve to know your brokerage is staying ahead of the curve.


Real-Life Risks Arizona Sellers Face

So what does this look like in real life? Here are a few of the most common situations where Arizona sellers get into trouble:

Roof Leaks & Repairs

Let’s say your roof leaked five years ago, and you had it repaired. You might think that problem is behind you—but under Arizona law, it still needs to be disclosed on the Seller’s Property Disclosure Statement (SPDS). If you don’t list it, and the buyer later discovers evidence of that leak, they may have grounds for legal action.

Unpermitted Additions

Converted garages, bonus rooms, or backyard structures are common in Arizona. If those improvements were not permitted and you don’t disclose them, the buyer could come back to you later with claims for misrepresentation—or worse, demand you cover the cost of bringing the work up to code.

Insurance Claims History

Every buyer receives a CLUE Report showing past insurance claims on your property. If the claims on that report don’t match what you disclosed, it raises a big red flag. At best, it delays your closing. At worst, it becomes the basis for a lawsuit down the road.

Neighborhood Issues or Boundary Disputes

Did you ever argue with a neighbor over a fence line? Did you know about an HOA violation that wasn’t resolved? These are the kinds of “material facts” that must be disclosed. If they’re left off, you could be liable for damages later.

Each of these examples represents not just a potential deal-breaker, but also a potential lawsuit. And once you’ve sold your home, the last thing you want is to be pulled back into a problem you thought you’d left behind.
